The purpose of these Terms and Conditions is to define the relationship between you as a client and/or user of our Services (“you”) and us. Wherever referred to “we”, “us” or “our” in these Terms and Conditions, we mean Vladimir Promotions Limited, Graigues, W91 PX63, Robertstown, Co. Kildare, Ireland, and/or Vladimir Jablokov, Graigues, W91 PX63, Robertstown, Co. Kildare, Ireland. Please read these Terms and Conditions carefully.
Services. The subject matter of the relationship between you and us is the provision of private concerts entitled “Vladimir’s Theatre” by us to you via the means of online audio/video transmission as specified below (the “Services”) in accordance with your respective order and further arrangements as agreed. The Services primarily comprise the following Packages:
(hereinafter together referred to as “Packages” or individually as a “Package”).
All of the above Packages represent real-time exclusive online concerts, i.e. live private performances only for you. The scopes of each of the Packages are defined on the website of the Services, https://vladimirmusic.com/private (hereinafter referred to as “our website”). However, we reserve the right to modify the description of each category in case of occurrence of force majeure.
Line-Up. For any of the Packages as described on our website, the line-up shall correspond with the descriptions of the respective Packages published on our website (basically, all performances are always led by Vladimir Jablokov and the remaining line-up of performers depends on the type of the respective Package). However, please note that in the event that any other performer apart from Vladimir is unable to participate in the concert due to unexpected situations, such as COVID19-related restrictions or any other events of force majeure, we reserve the right to substitute such affected person with another performer.
Tools. All Services are provided via online audio/video communication tool ZOOM. For this reason, you need to install Zoom application on your computer/mobile device and register for a Zoom account (the basic free version is sufficient). It is strongly recommended that you check the functioning of Zoom prior to the performance of Services. If requested, we can provide you with reasonable assistance in installation and basic set-up of Zoom prior to your scheduled concert. Pricing. All Prices for the respective Services are specified on our website and are valid as at the time of booking. The final price depends on the exact time and date of the chosen performance. Special offers (discounts) may be applied to certain Packages from time to time.
Our obligations and commitments. We undertake to provide the Services in the highest possible audio and video quality using the state-of-the-art audio/video equipment, IT devices and professional software we possess. Unless any unexpected event of force majeure occurs, we also guarantee stable and fast Internet connection from our side and undertake to deliver the ordered Services properly and timely. Furthermore, we are obliged to provide the Services in accordance with your order that matches the respective Services description published on our website as well as with our further arrangements mutually confirmed in writing (by email). If we do not deliver the quality level we commit to, you agree to inform us thereof without delay and we will work with you to try to resolve the problem. In the event we fail to meet our obligations and commitments even after being notified thereof from your side, you will be eligible for a refund.
Your obligations and commitments. Primarily, you undertake to follow the date and time of performance of our Services that you selected and as mutually agreed and confirmed. In case you do not participate in the performance of our Services, i.e. do not establish the connection with us at the date and time mutually agreed and confirmed, the Services you ordered shall be deemed to be duly performed and therefore shall not be refunded.
Further, when booking any Package of our Services, you agree that you have, or in due course will have, all the required hardware and software background for proper performance of the Services. Specifically, you are required to ensure that prior to the scheduled time of provision of our Services, you will have (a) a suitable device, e.g. a laptop or a mobile device (a mobile phone or a tablet) with the Zoom tool installed and properly functioning, and (b) fast and stable Internet connection. In case of occurrence of any technical problems with establishing connection, you agree to check the settings of your device/software and Internet connection settings first. If problems persist, we may provide you with reasonable assistance in making our interconnection successful; however, to this extent, we shall not bear responsibility for any kind of technical failure on your side.
All our live audio/video performances within the provision of Services are subject to copyright. Without our prior express written consent, you may not record any performance or any part thereof, as this would cause copyright infringement.
Protecting the privacy of all our clients is of vital importance for us. For this reason, we require your personal data only to the minimum extent possible to be able to provide services to you in a due and timely manner, e.g. we need such data for establishing communication with you. When processing your personal data, we adhere to any and all applicable national and European legal regulations, in particular, the Regulation (EU) No. 2016/679 of the European Parliament and the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation) (“GDPR”).
Definitions. In accordance with the GDPR, for the purposes of the subject matter of relationship between you and us, (a) we act as the data controller, and (b) you act as a data subject.
Personal Data Required by Us. We require your personal data within the following scope: first name(s) and surname, email address, postal address (if applicable) and telephone number (“Personal Data”).
Purpose of Personal Data Collection. In accordance with the GDPR, we collect and process Personal Data for the exclusive purposes of ensuring proper delivery of our services. We may use your email address for future marketing purpose (i.e. for the occasional delivery of email newsletters). We do not:
(a) process any Personal Data for any other than above purposes;
(b) transfer any Personal Data to any third parties or process any personal data through any third-party vendor;
(c) disclose any Personal Data to any subjects, unless being legitimately requested to do so by state authorities pursuant to applicable legal regulations (e.g. tax authorities);
(d) use any form of automated processing of personal data (profiling);
(e) send any promotional materials to your postal address or send spam emails.
Retention Period. Your Personal Data will be stored only for as long as it is necessary for the performance of Services. However, we may retain your email address for further marketing purposes (i.e. for the occasional delivery of email newsletters) for the period of 5 (five) years following the provision of our Services. If you do not wish to receive any promotional emails, please proceed in accordance with Marketing Opt-Out chapter below.
Third-Party Personal Data Collection and Processing. We declare that we do not process personal data by means of any third-party subject (referred to as the Processor pursuant to the GDPR). All personal data is processed by us exclusively.
Rights of Data Subjects. As a data subject within the meaning of the GDPR, you are entitled at any time to exercise your following data protection rights under the GDPR: the right to access, rectify, require erasure as well as restrict processing. To this extent, we will respond to all legitimate requests for information about personal data stored by us and, where applicable, to all legitimate requests to correct, update, or erase your personal data.
Marketing Opt-Out. We value your privacy and we do not like receiving frequent spam messages, just like you. Because of this, we send promotional emails to our clients only occasionally. However, you have the right to opt out of receiving email newsletters or any other promotional emails from us at any time, simply by sending an email to email@example.com with the subject “Newsletter Opt-Out” from the same email address you submitted to our system (the email body may be left blank). You will receive an email from us confirming the removal of your email address from our database in due course.

Legislation & Jurisdiction. These Terms and Conditions, as well as any rights and obligations not expressly stated herein, shall be governed by the law of the Republic of Ireland. You and we agree that any disputes that may arise from- or in connection with the provision of Services shall be settled amicably whenever possible. However, in case of failure to reach a mutually agreed solution, such disputes shall be settled by the respective court of County Kildare, Republic of Ireland.
Effective Date. These Terms and Conditions shall become effective as of 18 January 2021.
Further Amendments. These Terms and Conditions may be amended from time to time. Their up-to-date version is published on our website.
Your Consent. By purchasing and using our Services, you expressly agree with these Terms and Conditions.
